The City of Hamilton is pursuing legal action against GFL Environmental Inc., operator of the Stoney Creek landfill, after persistent odours and alleged environmental violations have affected nearby residents for years.
Hamilton City Council voted unanimously Thursday to direct the city solicitor to file a court application under the Ontario Municipal Act that could force the landfill to abate odour issues or temporarily halt operations until compliance is ensured. Council cited hundreds of complaints from local residents, including reports of “rotten egg” smells, headaches, and other health-related concerns, dating back to April 2023.
“People haven’t been able to enjoy their own homes,” said Ward 9 Councillor Brad Clark, who introduced the motions calling for judicial relief. “This action is about holding the operators accountable and protecting public health and the environment.”
The Ontario Ministry of the Environment, Conservation and Parks previously charged GFL with 10 provincial offences under the Environmental Protection Act for odour emissions and breaches of environmental compliance agreements, issuing fines in 2024 and 2025. Despite enforcement efforts, residents reported ongoing odours throughout 2025, prompting the city to pursue legal remedies.
Hamilton officials noted that the municipal action complements provincial oversight, emphasizing the need for timely enforcement and protection of local communities affected by industrial operations. GFL Environmental has not yet responded to requests for comment.
The Stoney Creek landfill, one of the largest in the region, has faced years of scrutiny from residents and environmental groups, with the city now taking more formal steps to address ongoing complaints and ensure compliance with environmental standards.
